Jet Spark Electrical - Terms and Conditions inc warranty
Acceptance of Terms and Conditions By accepting a quote from Jet Spark Electrical or engaging us for a ‘cost plus’ task (whether in writing, email, text, verbally, or by pressing the ‘Accept’ button in a quote email), you (the "Customer") agree to the terms and conditions outlined in this document.
Validity of Quote Quotes provided by Jet Spark Electrical are valid for 20 days from the date of issue. After this period, the quote may be subject to revision due to changes in pricing, material costs, or other factors. If the quote expires, a new one may be provided upon request. Only prices specified in documents labelled ‘quote’ will be considered as set prices for the scope of work. Pricing provided in other formats is considered an estimate only and may vary.
Scope of Work (Quotes) The scope of work to be carried out is as detailed in the quote description. Any additional work or changes requested outside of this scope will incur additional charges.
Payment Terms (Quotes) Payment is due as per the terms outlined in the individual quote. Unless otherwise specified. For quotes exceeding $6,000 (inc GST), a 20% deposit is required prior to material procurement and job scheduling. Special-order materials require full payment prior to procurement. The balance is due upon completion of the work, unless otherwise agreed upon. Late payments will incur a 5% interest charge per week on any overdue balance.
Variations Any changes or variations to the work requested by the Customer must be agreed upon in writing by both parties. Additional charges will apply for variations from the original quote.
Consequential Tasks The Customer accepts that unforeseen issues or previously undetected electrical faults may arise during the work, requiring additional tasks to be performed before proceeding. The Customer agrees that these additional works and associated costs may be necessary to resolve such issues. Jet Spark Electrical does not assume responsibility for the costs involved in addressing them.
Access to Property The Customer is responsible for ensuring the work area is clear and safe before commencement of works. If additional time or effort is required due to lack of access or safety issues, the Customer will be responsible for any associated costs.
Cancellation If the Customer cancels the work after accepting the quote, Jet Spark Electrical reserves the right to charge for any work completed or materials purchased, regardless of delivery status. A cancellation fee may also apply, depending on the proximity of the cancellation to the scheduled start time.
Warranty and Defects Jet Spark Electrical grants the Customer a 12-month warranty from the date of practical completion on all works and materials supplied. In the event of an electrical or mechanical failure within the warranty period, we will either repair the fault, or replace the item, or pay for the necessary repairs. This warranty is in addition to any legal rights and remedies. Warranty Limitations: The maximum payable under this warranty is limited to the price paid for the works, inclusive of GST. This warranty does not cover products not manufactured by Jet Spark Electrical, which are covered only by the manufacturer's warranty. Jet Spark Electrical is not responsible for warranty claims on third-party materials or for consequential losses. What is not covered: Consumables (light globes, batteries, fuses, etc.), normal maintenance costs, product recalls, damage due to negligence, accidental misuse, unauthorized repairs, liquid penetration, power surges, vermin, corrosion, or excessive use.
Non-Refundable Deposits, Call-Out Fees, and Travel Fees All deposits are non-refundable as they secure materials, scheduling, and planning. A $200 call-out fee may be charged for jobs outside the standard service area or for assessment visits on top of the normal labour rate. This fee is non-refundable if the Customer decides not to proceed. The standard service area is a 60km radius from Mansfield town centre. For cost-plus jobs, labour charges start when staff leave Mansfield and stop when they leave the customer’s property and are charged at 30-minute increments.
Cancellations & Rescheduling Customers must provide at least 5 working days’ notice in writing for cancellations. Failure to do so will result in forfeiture of the deposit or a cancellation fee of 10% of the quoted amount whichever it greater. Jet Spark Electrical reserves the right to reschedule appointments at its discretion.
Insurance Jet Spark Electrical holds appropriate public liability insurance for all work undertaken. The Customer is responsible for their own insurance coverage for their property during the work period.
Compliance with Laws and Regulations All work carried out will comply with relevant Australian standards and legislation, including AS/NZS 3000:2018 and local safety regulations in Victoria.
Liability We are not liable for indirect or consequential damages, pre-existing faults, or unforeseen issues such as underground obstructions or structural defects.
Dispute Resolution Both parties agree to attempt to resolve any dispute amicably. If a resolution cannot be reached, the matter may be referred to a mediator.
Privacy Jet Spark Electrical respects the privacy of the Customer’s personal information. Personal details will only be used for completing the agreed tasks and will not be shared with third parties unless required by law or with the Customer’s consent.
Material Supply Jet Spark Electrical only supplies and installs materials approved for use in the Australian electrical network. We are not responsible for delays in the supply chain outside our control.
Payment Terms An invoice will be issued upon completion of the work, with payment due by the stated due date. A late fee of 5% per week will be added to overdue amounts. If payment is not received within 60 days, debt collection services may be engaged. Materials supplied by Jet Spark Electrical remain our property until full payment is made.
Buried and Hidden Services Jet Spark Electrical is not liable for damage to buried or unseen services. Customers must provide accurate site plans for underground pipes and cables before work begins. We will request a ‘Dial Before You Dig’ survey prior to machine-assisted earthworks, but we are not responsible for items not listed in the report. The Customer acknowledges that private assets are rarely included in these surveys.
